1. Agreement to Terms

By accessing or using Kollekt Technologies' delivery marketplace platform, website, or mobile applications ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services. These Terms constitute a legally binding agreement between you and Kollekt Technologies.

2. Platform Description

Kollekt Technologies operates a fair delivery marketplace that connects customers with transporters. We provide a platform for users to post delivery jobs and for transporters to accept and complete these jobs. We facilitate payment processing but are not a party to the delivery service contracts between customers and transporters.

3. User Accounts

To use our Services, you must:

  • Be at least 18 years old
  • Provide accurate, complete registration information
  • Maintain the security of your account credentials
  • Promptly update any changes to your information
  • Accept responsibility for all activities under your account

You may not share your account, create multiple accounts, or transfer your account to another party.

4. Payment Terms

4.1 Subscription Payments

Transporters must subscribe to use the platform. Subscription fees are non-refundable except as required by law or stated in our refund policy. Subscriptions automatically renew unless cancelled before the renewal date. You authorize us to charge your payment method on file for recurring subscription fees.

4.2 Customer-to-Transporter Payments

Customers may pay transporters through the following method:

  • QR Code Direct Banking Transfer: Customers can pay transporters directly via QR code generated banking transfers. These transactions occur directly between parties' bank accounts. Kollekt Technologies is not responsible for disputes arising from direct banking transfers.

4.3 No Commission Fees

Unlike other platforms, Kollekt Technologies does not charge commission fees on delivery transactions. Transporters keep 100% of the agreed payment amount.

4.4 Payment Disputes

For direct QR code transfers, parties must resolve disputes directly as we do not have access to these transactions. We may provide transaction records if available to assist resolution.

5. User Responsibilities

5.1 For Customers:

  • Provide accurate delivery information and requirements
  • Ensure items comply with legal requirements and platform policies
  • Make timely payments through chosen payment method
  • Verify delivery and release on-hold payments promptly
  • Treat transporters with respect and professionalism

5.2 For Transporters:

  • Maintain active subscription to accept jobs
  • Possess valid licenses, insurance, and vehicle documentation
  • Deliver items safely and on time as agreed
  • Provide accurate vehicle information and availability
  • Communicate professionally with customers
  • Report any delivery issues promptly

6. Prohibited Activities

Users may not:

  • Transport illegal, dangerous, or prohibited items
  • Provide false information or impersonate others
  • Circumvent payment systems or avoid subscription fees
  • Harass, threaten, or abuse other users
  • Attempt to hack, disrupt, or exploit the platform
  • Use the platform for any unlawful purpose
  • Post spam, advertising, or misleading content
  • Collect user data without authorization

7. Service Availability

We strive to maintain uninterrupted service but do not guarantee the platform will always be available. We may suspend or terminate services for maintenance, updates, or other reasons. We are not liable for any unavailability, interruption, or data loss.

8. Intellectual Property

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, and software, are owned by Kollekt Technologies and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

9. Limitation of Liability

Kollekt Technologies acts as a platform connecting customers and transporters. We are not responsible for:

  • Quality, safety, or legality of delivered items
  • Actions, conduct, or performance of users
  • Damage, loss, or delay of deliveries
  • Disputes between customers and transporters
  • Issues with direct QR code banking transfers
  • Third-party payment processor errors or delays

To the maximum extent permitted by law, our liability is limited to the amount of subscription fees paid in the 12 months preceding any claim.

10. Indemnification

You agree to indemnify and hold Kollekt Technologies harmless from any claims, damages, losses, liabilities, and expenses arising from your use of the Services, violation of these Terms, or infringement of any rights of another party.

11. Termination

We may suspend or terminate your account at any time for violating these Terms or for any reason we deem appropriate. You may cancel your account at any time through account settings. Upon termination, your right to use the Services ceases immediately. Subscription fees are non-refundable upon termination except as required by law.

12. Dispute Resolution

Any disputes arising from these Terms or use of our Services shall be resolved through binding arbitration in accordance with the laws of the jurisdiction where Kollekt Technologies is registered. You waive the right to participate in class action lawsuits.

13. Governing Law

These Terms are governed by the laws of Malaysia and Singapore, depending on your location and applicable jurisdiction, without regard to conflict of law principles.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of our Services after changes constitutes acceptance of the modified Terms. Material changes will be communicated via email or platform notification.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
